Q. What's best - state or federal court?
- State. Since the start of the 1990s all asbestos cases filed in federal court have been allocated to one Philadelphia judge. The judge has never allowed a claim for punitive damages as would have been allowed under state law. As the asbestos corporations know the federal court will protect them they will endeavour to have the case heard there - while plaintiffs attorneys will try their best to have the case held in state court.
